I. Definitions
 
   The terms used in the Regulations shall mean:
 
   1. Customer - a natural person, a legal person or an organisational unit that is not a legal person, to which special regulations grant legal capacity, who makes an Order within the framework of the Store;
 
   2) Civil Code - the Act of 23 April 1964 (Journal of Laws No. 16, item 93, as amended);
 
   3. Terms and Conditions - these Terms and Conditions for the provision of electronic services as part of the online shop www.salony.ruke.eu;
 
   4. online shop (Store) - Internet service available at http://www.salony.ruke.eu, through which the Customer may, in particular, place Orders;
 
   5. merchandise - products presented in the Online Store;
 
   6th Sales agreement - agreement for the sale of Goods, as defined by the Civil Code, concluded between RUKE (registered at ul. Słowackiego 11, 24-100 Puławy NIP: 716-164-40-60)and the Customer, concluded with the use of the website of the Shop;
 
   7th Act on special terms and conditions of consumer sale - Act of 27th July 2002 on special terms and conditions of consumer sale and amending the Civil Code (Journal of Laws No. 141, item 1176 as amended);
 
   8. the Act on Electronic Provision of Services - the Act of 18 July 2002 on Electronic Provision of Services (Journal of Laws No. 144, item 1204 as amended);
 
   9. order - Customer's declaration of will, aiming directly at concluding the Sales Agreement, specifying in particular the type and number of Goods.
 
 
II. General provisions
 
   2.1 These Terms and Conditions define the rules for the use of the online shop available at www.salony.ruke.eu.
 
   2.2 These Regulations are the regulations referred to in Article 8 of the Act on electronic provision of services.
 
   2.3 The online shop at www.salony.ruke.eu is operated by RUKE (registered at ul. Słowackiego 11, 24-100 Puławy NIP: 716-164-40-60) .
 
   2.4 These Terms and Conditions set out in particular:
 
     a.) the principles of registration and use of an account within the online shop;
 
     b.) terms and conditions of electronic reservation of products available in the Internet shop;
 
     c.) terms and conditions for electronic placement of Orders within the online shop;
 
     d.) principles of concluding Sales Agreements with the use of services provided within the framework of the Internet shop.
   2.5 The use of the online shop is possible on condition that the ICT system used by the Customer meets the following minimum technical requirements:
 
     a.) Internet Explorer version 4.0 or higher with cookies enabled, or
 
     b.) Mozilla FireFox version 4.0 or higher with cookies enabled, or
 
     c.) Google Chrome version 1.0 or later with cookies enabled.
 
   2.6 In order to use the online shop, the Customer shall himself/herself have access to a computer workstation or terminal device with Internet access.
 
   2.7 In accordance with applicable law, RUKE reserves the right to restrict the provision of services via the Online Shop to persons over the age of 18. In such a case, prospective Customers will be notified of the above.
 
   2.8 The Customers may access these Terms and Conditions of Use at any time via the link provided on the home page of www.salony.ruke.eu and may download and print them.
 
   2.9 Information about the Goods given on the websites of the Store, in particular their descriptions, technical and usable parameters and prices, constitute an invitation to conclude a contract within the meaning of Article 71 of the Civil Code.


III. Rules of using the Internet Shop
 
   3.1 A prerequisite for the use of the Online Shop is its registration.
 
   3.2 Registration takes place by completing and accepting a registration form, made available on one of the pages of the Shop.
 
   3.3 Registration is conditional on agreeing to the content of the Terms and Conditions and providing personal data marked as mandatory.
 
   3.4 RUKE may deprive the Customer of its right to use the Online Shop, as well as restrict its access to part or all of the Online Shop's resources, with immediate effect, in the event that the Customer violates the Terms and Conditions, and in particular when the Customer:
 
     a.) provided data which is untrue, inaccurate or out-of-date, misleading or violating the rights of third parties during the registration in the Internet shop,
 
     b.) has violated the personal rights of third parties through the online shop, in particular the personal rights of other customers of the online shop,
 
     c.) shall behave in any other manner which is deemed by RUKE to be in breach of applicable law or of the General Business Terms and Conditions or to be detrimental to the reputation of RUKE.
 
   3.5 A person who has been barred from using the Online Shop may not register again without prior consent from RUKE.
 
   3.6 In order to ensure the security of the transmission of messages and data in connection with the services provided on the Website, the Online Shop shall take technical and organisational measures appropriate to the degree of security threat to the services provided, in particular measures to prevent unauthorised persons from obtaining and modifying personal data transmitted on the Internet.
 
   3.7 In particular, the Customer is obliged to:
 
     a.) not to provide or transmit content that is prohibited by law, e.g. content that promotes violence, defamatory or infringes personal rights and other rights of third parties,
 
     b.) use the Internet Shop in a manner that does not disrupt its operation, in particular by using specific software or devices,
 
     c.) not to undertake actions such as sending or posting unsolicited commercial information (spam) within the scope of the Internet Shop,
 
     d.) to use the Online Shop in a manner that is not disruptive to other customers and to RUKE,
 
     e.) to use any content available in the Online Shop for personal use only,
 
     f.) to use the Online Shop in a manner compliant with the provisions of the law in force in the Republic of Poland, the provisions of the Terms of Use, as well as with the general principles of Internet use.
 
 
IV. Procedure for concluding a Sales Agreement
 
   4.1 In order to conclude a Sales Agreement by means of the On-line shop, it is necessary to enter the website www.salony.ruke.eu, make a selection of goods and their quantity (expressed, depending on the type of goods, in units or grams), taking subsequent technical actions on the basis of messages displayed to the Customer and information available on the website.
 
   4.2 The Customer selects the Goods to be ordered by adding them to the shopping basket.
 
   4.3 During the process of placing the Order - until the moment of pressing the "Order" button - The Customer has the possibility to modify the data entered and with regard to the selection of the Goods. For this purpose, it is necessary to follow the messages displayed to the Customer and the information available on the site.
 
   4.4 After the Customer using the Online Shop has provided all the necessary data, a summary of the Order placed shall be displayed. The summary of the Order placed shall contain information concerning:
 
     a.) the subject of the Order,
 
     b.) unit price and total price of the ordered products or services, including delivery costs and additional costs (if any),
 
     c.) the selected payment method,
 
     d.) the selected method of delivery,
 
   4.5 In order to send the Order, it is necessary to accept the content of the Terms and Conditions, provide personal data marked as mandatory and press the "Place order" button.
 
   4.6 The Customer's sending of the Order constitutes a declaration of will to conclude a Sales Agreement with RUKE, in accordance with the content of the Regulations.
 
   4.7 After placing an Order, the Customer shall receive an e-mail message entitled "salony.ruke.eu- Confirmation of receipt of order", containing a final confirmation of all material elements of the Order.
 
   4.8 The Contract shall be deemed concluded at the moment of receipt by the Customer of the e-mail referred to above.
 
   4.9 The Contract of Sale shall be concluded in the Polish language, with the content compliant with the Terms and Conditions.


V. Delivery
 
   5.1 Delivery of the ordered Goods shall be made by courier service. Delivery costs are available on the Delivery and Payment page. In addition, the delivery costs will be indicated at the time of placing the Order.
 
   5.2 The delivery period is between 6 and 20 working days from the date the Customer sends the Order.
 
   5.3 The Customer may access these Terms and Conditions at any time through the link on the homepage of www.salony.ruke.eu and download and print them.
 
Recording, securing, making available and confirming to the Customer the material provisions of the Agreement for the sale of the Goods shall take place by sending the Customer a printout of the confirmation, the Order specification and the VAT invoice to the e-mail address provided and by enclosing it to the parcel containing the Goods.
 
 
VI. Prices and payment methods
 
   6.1. The prices of the Goods shall be given in Polish zloty and include all components, including VAT, customs duties and any other components.
 
   6.2 The Customer shall have the option to pay the price:
 
     a.) by bank transfer to the bank account number,
 
     b.) in the case of cash on delivery, the Customer may pay the fee to the courier.
 
 
VII. Right of withdrawal
 
   7.1 The Customer, who is a consumer within the meaning of Article 221 of the Civil Code, has the right - pursuant to the provisions of law - to withdraw from the Contract concluded at a distance, without giving any reason, by submitting an appropriate statement in writing within 14 days and sending it to the address of RUKE specified in these Terms and Conditions.
 
   7.2 The 14-day period shall run from the day on which the Goods are delivered.
 
   7.3 The consumer's right of withdrawal is excluded in the case of goods (services) that go beyond the standard offer of the shop, prepared for the customer's special order and tailored to his/her individual needs. In the case of the shop: www.salony.ruke.eu, these will be mirrors made to individual size, entered manually when placing the order (from outside the catalogue of standard sizes), mirrors for which panel cuts have been made (models: Milly, Luna, Nelly, etc.) and goods for which the customer has chosen additional attributes going beyond the standard ones, i.e. - light colour, manufacturing technology, switch;
 
   7.4 In the event of withdrawal from a contract concluded at a distance, the contract shall be deemed not to have been concluded. What the parties have rendered shall be returned unchanged, unless the change was necessary within the limits of ordinary management. The return should be made immediately, no later than within 14 days. The purchased goods should be returned to the following address:

   7.5 The Goods returned by the Customer should be packed in an appropriate way in the original box, ensuring no damage to the parcel during transport.
 
   7.6 The cost of transportation of the goods in case of return shall be borne by the Seller.
 
 
VIII. Complaints concerning the Goods

I. Definitions
 
The terms used in the Terms of Use shall mean:
 
1. manufacturer - means the company RUKE registered at ul. Słowackiego 11, 24-100 Puławy NIP: 716-164-40-60;
2. Vendor - a natural person, a legal entity or an organisational unit that is not a legal entity, to which special laws grant legal capacity, which sells products purchased from the Manufacturer in the course of its business. 3;
3. goods - products purchased by the Vendor from the Manufacturer;
4. the Consumer Rights Act - the Consumer Rights Act of 30 May 2014 (i.e. Journal of Laws No. 2017, item 683 as amended);
5. Customer - a natural person, a legal person or an organisational unit that is not a legal person, to which special regulations grant legal capacity, who makes an Order within the Shop.
 
 
II. Complaints regarding the Goods
 
(1) The Seller is obliged to check the quality of Goods immediately upon their receipt. If the Seller finds any defects or inconsistencies between the delivered Goods and the delivery document, the found defects or inconsistencies of the Goods will be entered into the protocol drawn up in writing by the Seller. The protocol will be drawn up immediately after receipt of the delivery by the Seller. The protocol will be sent by the Seller to the Manufacturer by fax or e-mail, no later than within 2 (two) days from the delivery of the Goods.
(2) Complaints resulting from damage to the Goods during transport should be reported immediately on the day of receipt of the shipment. The report must be accompanied by a damage report written in the presence of the carrier and photographic documentation. Reporting the damage after 2 days will be considered as occurring at the Seller.
(3) A complaint regarding the quality of the Goods delivered to the Manufacturer may be based only on the Goods which are left at the Manufacturer's disposal and do not bear signs of mechanical damage.
4th In the case of acknowledgment of the complaint by the Producer, the Producer is obliged to collect the faulty Goods, provide full-quality Goods or return the purchase price paid by the Seller for the returned Goods and related costs, within 14 days from the acknowledgment of the complaint.
(5) The Goods returned by the Seller should be packaged in an appropriate manner in the original box, ensuring that the parcel is not damaged in transit.
6th The cost of transport of goods in the case of return shall be borne by the Manufacturer.
7th The Producer shall be liable to the Seller for defects of the Goods under warranty for the sold Goods on the principles regulated in the Civil Code.
8th Complaints about Goods submitted to the Vendor by the Customer shall be sent to the Manufacturer by fax or e-mail. In each case the complaint should contain the Customer's data (name, surname, address), details of the Goods, description of defects of the Goods, date and signature of the Customer and signature of an authorised employee of the Seller. Alternatively, photographs of the defects of the Goods provided by the Customer may be attached to the complaint. In case it is necessary to deliver the Goods in order to properly consider the complaint, the costs of transport of the Goods shall be borne by the Seller. 9.
(9) If the defective Goods have been assembled at the Customer's premises, the Seller may request disassembly and reassembly after replacing the Goods with defect-free ones or after removing the defect. The Seller shall refuse disassembly and reassembly if the cost of these activities exceeds the price of the Goods. The Client shall be obliged to bear a part of costs connected with disassembly exceeding the price of the Goods or may request the Seller to pay a part of costs of disassembly and reassembly, up to the amount of the price of the Goods.


IX. Complaints regarding the provision of electronic services
 
   9.1 RUKE shall take steps to ensure the fully correct operation of the Store, to the extent resulting from the current technical knowledge, and undertakes to remove within a reasonable time any irregularities reported by the Customer.
 
   9.2 The Customer is obliged to immediately notify RUKE of any irregularities or interruptions in the operation of the Online Store service.
 
   9.3 The Customer may report irregularities related to the functioning of the Shop in writing to the address: 

RUKE, 11 Słowackiego Street, 24-100 Puławy, by email to salony@ruke.eu or by using the contact form.
 
   9.4 In the complaint the Customer should give his/her name, address for correspondence, type and date of occurrence of the irregularity connected with the functioning of the Shop.
 
   9.5 RUKE undertakes to consider each complaint within 14 days.
 
X. Privacy Policy
 
 
I. Who processes personal data and for what purpose
The personal data provided to us by you in connection with the registration and use of the Online Shop www.salony.ruke.eu is processed by RUKE Zbigniew Rus with its registered office in Puławy at 11 Słowackiego Street, NIP: 716-164-40-60, which is the controller of such data in accordance with applicable regulations, in particular Polish law and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation, RODO).
 
1. to the extent necessary for the establishment, shaping of the content, modification, termination and proper execution of services provided electronically and for the execution of orders placed by you; 2. to the extent necessary for the execution of orders placed by you for products in the assortment of the Online Shop www.salony.ruke.eu; 3. to the extent necessary for the processing of complaints submitted by you and for the return of services in the event of withdrawal from the contract (return of goods); 4. If you agree to receive marketing information from us, including sending you commercial information by e-mail, your personal data will also be processed by us in order to provide you with information about our shop, our offer and promotions, as well as information concerning products and services of entities cooperating with us (with our knowledge and express consent).
 
Providing personal data is voluntary, however, lack of consent for us to process your personal data may prevent us from providing you with electronic services and from making purchases from the www.salony.ruke.eu Internet Shop.
 
By entrusting us with your personal data, you have the right to access it, the right to request that it be updated and the right to request that it be deleted. You can edit and delete the personal data provided by you in your customer account yourself ("Your account" tab). You can also request us to delete your entire customer account by sending a request to the e-mail address: salony@ruke.eu from the email address currently registered with the Online Shop www.salony.ruke.eu. If you would like to unsubscribe from the newsletter then you can do so yourself or by contacting us from the email address currently registered with the Online Shop www.salony.ruke.eu. Information on how to unsubscribe from the newsletter is also indicated in the footer of each newsletter.
 
II. Security rules

Ruke Zbigniew Rus ensures the security of personal data through appropriate technical and organisational measures aimed at preventing unlawful data processing and accidental loss, destruction and damage. Furthermore, we take special care to ensure that personal information is:
 
correct and processed lawfully, obtained only for the purposes specified and not further processed in a manner incompatible with those purposes, adequate, relevant and not redundant, accurate and up-to-date, not kept longer than necessary, processed in accordance with the rights of the persons (to whom it relates), including in accordance with the right to reserve access, securely stored, not transferred without adequate protection.
 
Remember that your nickname and your email address stated as public will be visible to all persons using the Online Shop www.salony.ruke.eu If you do not wish to share your personal data with an unlimited circle of persons, do not state it as public.
 
For your security, please remember to:
 
1. set up a login and password for your Customer account that makes it impossible for third parties to easily guess them. In particular, we recommend that you use a string of characters and numbers as well as upper and lower case letters in your password;
 
2. logging out of www.salony.ruke.eu after the end of the session (finished shopping, posting messages on the forum, etc.). Simply closing the browser window is not the same as logging out of www.salony.ruke.eu. Logging out of www.salony.ruke.eu will be done by clicking the "Log out" button;
 
3. to keep the login and password to the Customer's account confidential, in particular not to disclose the data (login, password) to any third party;
 
4. to use anti-virus software, including regular scanning of disks for viruses;
 
5. to use the website and the Online Shop www.salony.ruke.eu only via trusted computers on which only verified software is installed. If you use someone else's computer, there is a risk that your login name, password or other details you provide may be intercepted;
 
6. If, however, you access the website or the www.salony.ruke.eu Internet Shop using a third-party computer, e.g. in an Internet cafe, remember not to save the data on your computer and to delete the history of pages viewed. The saved data may be used by the person who uses the computer after you.
 
III. Technical information

Technical information - cookies
 
When you use the www.salony.ruke.eul Internet Shop, small files (especially text files) containing information necessary for the proper use of the www.salony.ruke.eu Internet Shop, so-called cookies, are saved on your terminal device (computer, smartphone, tablet, etc.). Thanks to storing these files on your device, it is possible, among other things, to remember your login data so that you do not have to enter your login and password each time, remember the goods you have added to your basket or adjust the content of the website to your interests. Thanks to cookies it is possible to collect statistical data of the www.salony.ruke.eu Internet Shop, which enables us to develop the Shop according to the preferences of our Customers.
 
Cookies do not contain data that identifies you; it is not possible to establish anyone's identity on their basis. These files are not in any way harmful to your device and do not change its settings or the settings of the software installed on it. The content of these files can only be read by the server that created them.
 
We use two types of cookies when you use the www.salony.ruke.eu Online Shop: session cookies and permanent cookies. Session cookies are temporary files which are stored on your device until you log out of the www.salony.ruke.eu Web Shop, leave the www.salony.ruke.eu Web Shop or close your browser. Permanent files are stored on your device for the time specified in the parameters of these files or until they are deleted by you.

What cookies do we use?
a) Files necessary for the operation of the Shop - these files enable the proper operation of the Internet Shop www.salony.ruke.eu logging into the Shop, navigating through the Shop, making purchases and downloading purchased files from the Shop. Without these files being saved on your device, it is not possible to use the Shop;
b) Files which ensure the security of transactions made in the Store. Lack of these files will prevent secure transactions;
c) Statistical files - allow us to collect statistical information about the use of the Shop;
d) Functional files - files enabling us to remember your settings and preferences. Thanks to storing these files on your device, you will not have to enter your login and password each time, you will be shown products adapted to your interests, etc.; d) Functional files - files enabling us to remember your settings and preferences;
e) Advertising files - files enabling you to receive personalised advertising. These files may be used by the Shop or by advertising service providers cooperating with the Shop, thanks to which you may be shown advertisements tailored to your interests, and the number of advertisements displayed may be limited thanks to which advertisements will be less burdensome, etc.
f) Social files - to enable the integration of the social networks (e.g. Facebook, Google+, Pinterest) you use with the Store.
 
What can you do if you do not agree to files being stored on your device?
 
Most browser settings allow cookies to be saved by default. If you do not agree to these files being stored on your device, you must change your browser settings accordingly. This can be done by not storing cookies on your device or by informing you each time a cookie is stored on your device. You can also delete files from your device each time you visit the Shop. Detailed information on the possibility and methods of handling cookies is available in the settings and "Help" section of your web browser. Please note, however, that restrictions on the use of cookies may make it difficult or impossible to use the Shop.

Other technical information
 
Your personal data is stored in a database in which technical and organisational measures have been applied to ensure the protection of the processed data in accordance with the requirements set out by generally applicable laws on the protection of personal data, including the regulation of the Minister of Internal Affairs and Administration of 29 April 2004 on personal data processing documentation and technical and organisational conditions to be met by devices and IT systems used for the processing of personal data (Journal of Laws No. 100, item 1024). Access to the database shall be allowed only to persons authorised by the data controller.
 
IV. Final provisions
Due to the continuous development and progress of technology, the principles set out in this document may be subject to change. You will be informed of changes to these rules in good time, no later than 7 days prior to their introduction, by posting the new content of this document on the website.
 
 
 
XI. Final provisions
 
   10.1 Settlement of potential disputes arising between RUKE and the Customer, who is a consumer within the meaning of Article 221 of the Civil Code, shall be submitted to the competent courts in accordance with the provisions of the relevant provisions of the Code of Civil Procedure.
 
   10.2 The settlement of any disputes arising between RUKE and a Customer who is not a consumer within the meaning of Article 221 of the Civil Code shall be submitted to the court having jurisdiction over the registered office of RUKE.
 
   10.3 To matters not covered by these Terms and Conditions, the provisions of the Civil Code, the provisions of the Act on Provision of Electronic Services and other relevant provisions of Polish law shall apply.
